Terms & Conditions

Effective date: 1 July 2025

These Terms & Conditions (“Terms”) govern your use of our website and your engagement of services with Hansberry Electrical Contractors EC8901 AU064810 (“we”, “our”, “us”, “Hansberry Electrical”). By accessing or using our website and/or engaging our services you agree to these Terms.

1. Definitions

  • “Client”, “you”, “your” means the person, firm or entity who purchases or engages our services or uses the Website.
  • “Services” means any residential, commercial, industrial electrical, air-conditioning, EV charger installation or emergency electrical services provided by Hansberry Electrical. · “Site” or “Website” means https://hansberryelectrical.com.au/ and all related web pages.
  • “Agreement” means the contract entered into between us and the Client for the provision of Services, incorporating these Terms and any quotation or job-sheet.

2. Quotation and scope of work

  • We will provide you with a written quotation (or verbally confirmed job-order) outlining the scope of Services, estimated price, timeline and payment terms.
  • Unless otherwise agreed in writing, any variation to the scope, additional work or change in site conditions may incur extra costs and time.
  • You authorise us to perform the Services as set out in the quotation/job order (including attending site, diagnosing, ordering, installing, repairing or maintaining electrical equipment).

3. Pricing and payment

  • The price for the Services will be as stated in the quotation or job order. Any additional work will be charged at our prevailing rates.
  • Unless otherwise agreed, payment is due upon completion of the work or by the date specified in our invoice.
  • We may require a deposit for parts or upfront work.
  • If you fail to pay on time, we may suspend further Services, charge interest, and recover our costs (including collection costs).
  • All prices are in Australian Dollars (AUD) and exclude goods and services tax (GST) unless stated.

4. Access to site

  • You must provide our personnel with safe and reasonable access to the site, including any relevant permissions (for example strata/tenant access in residential apartments) and ensure the work area is clear and safe.
  • We will endeavour to leave the work area in a clean, safe state following completion of Services. However, you recognise that on-site work may inherently involve disruption.

5. Warranties and liabilities

  • We warrant that our Services will be provided with due care and skill, and that materials supplied will be of good quality and fit for purpose.
  • Unless otherwise required by law, our liability for breach of any implied term, statutory condition or warranty is limited, at our option, to: (a) re-supplying the Services; or (b) refunding the amount paid for the Services.
  • To the maximum extent permitted by law, we exclude liability for any indirect or consequential losses, including loss of profit, loss of business, or damage to reputation.
  • You warrant that any information you provide to us (including site access, prior installations, hazards) is true and complete, and you accept responsibility for any harm or loss caused by your failure to do so.

6. Equipment, parts & materials

  • Unless otherwise agreed, any parts supplied by us remain our property until payment in full.
  • You will be responsible for any damage, theft or loss of parts once installed unless caused by our negligence.
  • We may dispose of old parts and materials (unless you instruct otherwise) and charge any disposal costs if applicable.

7. Emergencies and after-hours service

  • If you engage our emergency call-out service (available 24/7) you accept that after-hours rates may apply and additional charges may be incurred.
  • We will attend as soon as reasonably practicable; however we are not liable for any delay or inability to provide service due to circumstances beyond our control (storms, access issues, supplier delays, etc).

8. Intellectual property

  • The content on our website (including text, graphics, logos, images) is owned by or licensed to us and is protected by copyright and other intellectual property rights.
  • You may view and download content for your personal non-commercial use only. You must not reproduce, distribute, modify or otherwise use the content without our prior written consent.

9. Website use & disclaimers

  • The Website is provided “as-is”. We make no guarantee that the Website will be error-free, secure or uninterrupted.
  • We do not warrant the accuracy, completeness or suitability of any information on the Website. You rely on it at your own risk.
  • While we take steps to secure our website, we are not liable for any loss or damage arising from your use of the Website, your reliance on its content, or any linked third-party websites.

10. Privacy and cookies

  • Either party may terminate the service agreement by giving written notice if the other party is in material breach and fails to remedy within a reasonable time.
  • On termination or completion, you will pay for all Services performed up to the date of termination. Provisions which by their nature survive termination (such as intellectual property rights, limitation of liability) will continue to apply.

12. Governing law and jurisdiction

  • These Terms and any contract for Services are governed by the laws of Western Australia and the Commonwealth of Australia.
  • You submit to the non-exclusive jurisdiction of the courts of Western Australia.

13. Miscellaneous

  • You may not assign or transfer your rights under the agreement without our prior written consent.
  • If any provision of these Terms is found invalid or unenforceable, it will be severed and the remainder will continue in full force.
  • Headings are for convenience only and do not affect interpretation.

14. Changes to these Terms

We may revise these Terms from time to time. We will publish updated Terms on our Website and post the effective date. Your continued use of our website or engagement of our Services after changes constitute your acceptance of the updated Terms.
